THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.364 OF 2014 ORDER:

This petition is filed by the petitioners-accused Nos.1 & 2 under Section 482 Cr.P.C. seeking to quash the proceedings against them in C.C.No.350 of 2013 on the file of the II Additional Judicial First Class Magistrate, Kovvuru, West Godavari District. Heard and perused the material available on record. The petitioners are alleged to have committed the offence punishable under Sections 343, 348, 355, 179, 186, 109 and 506(II) r/w 34 IPC.

Considering the facts and circumstances of the case, this Court is not inclined to interfere with the proceedings in the above C.C.

At this stage, the learned Counsel for the petitioners prayed for dispensing with the presence of the petitioners before the Court below.

In view of the request made by the learned Counsel for the petitioners, the presence of the petitioners-accused Nos.1 & 2 before the Court below is dispensed with, except on the dates when their presence is insisted by the Court below. It is made clear that the petitioners shall be represented before the Court below through their Counsel on all hearing dates. With the above direction, the Criminal Petition is disposed of. Consequently, the Miscellaneous Petitions pending, if any, shall stand closed.
