THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.23381 of 2016 ORDER:

This writ petition is filed under Article 226 of Constitution of India seeking a writ of mandamus declaring the inaction of the respondent Nos.2 and 3 in taking any action with respect to the representations submitted by the petitioners on 04.7.2016 and 05.7.2016 is illegal, arbitrary and violative of principals of natural justice and consequently direct the respondent Nos.2 and 3 to consider the representations made by the petitioners on 04.7.2016 and 05.7.2016.

2. Heard Smt.Marella Radha, learned counsel for the petitioners and Sri P.Govind Reddy, learned Standing Counsel for respondent Nos.2 and 3.

A perusal of the record reveals that the third respondent issued election notification on 08.6.2016 for conducting elections to Office bearers of Non-Teaching Employees Association of Acharya N.G.Ranga Agricultural University, Guntur. The petitioners contested as Committee Members. The elections were conducted on 29.6.2016 and the results were declared on 02.7.2016. The petitioners are unsuccessful candidates in the elections. The contention of the petitioners is that the Returning Officer has not properly counted the votes; therefore, injustice was done to the petitioners. The petitioners submitted representations to the third respondent on 04.7.2016 and 05.7.2016 requesting him to recount the votes for the posts of President, Technical Secretary, Games & Cultural Secretary and Treasurer. For one reason or the other, no orders are passed on the representations of the petitioners.

4. The learned counsel for the petitioners submitted that the third respondent may be directed to consider the representations of the petitioners dated 04.7.2016 and 05.7.2016 and pass appropriate

orders.

Having regard to the facts and circumstances of the case and also the submissions made by the learned counsel for both the parties, the third respondent is hereby directed to dispose of the representations of the petitioners dated 04.7.2016 and 05.7.2016 as expeditiously as possible preferably within a period of fifteen (15) days from the date of receipt of a copy of this order.

6. With the above direction, the writ petition is disposed of. Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
