ORAL ORDER:

This writ petition is filed challenging the order of termination of Field Assistant dated 13.5.2010. This Court by order dated 14.9.2011 granted interim suspension of the order impugned and directed to take back the petitioner into service with further liberty to initiate appropriate proceedings in accordance with law, if any irregularities are noticed.

On instructions, learned standing counsel submits that as per the directions of this Court, petitioner was reinstated on 21.10.2011 and in the mean time, proceedings are initiated by the competent authority against the petitioner and on the allegation of the loss caused to the respondents on account of the misconduct of the petitioner, recovery proceedings were issued. The recovery proceedings are not under challenge. Petitioner did not pay the amount quantified and has stopped coming to duty after 10 days of joining the duty and as of now, petitioner is not working as Field Assistant. He would further submit that subject village is now falls under List II of categorization and only Senior-mate can be appointed and there is no requirement of Field Assistant. Having regard to these developments after the case is instituted and the fact that the petitioner is not working even after reinstatement, no relief as sought for by the petitioner can be granted. Writ Petition is accordingly dismissed. No costs. Having regard to the same, miscellaneous petitions, if any pending, are closed.
