THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.13049 of 2005 ORDER:

This writ petition was filed assailing the show-cause notice dated 06.06.2005 issued by the Kasturba Gandhi Degree and P.G. College for Women, Secunderabad, the first respondent, whereby the petitioner was asked as to why her services should not be terminated. By order dated 20.06.2005, this Court directed the first respondent to permit the petitioner to join and discharge her duties as Head of the Department of Mathematics. The said order was made absolute on 14.09.2007 and the vacate stay petition filed by the first respondent was dismissed.

The petitioner was aged 54 years at the time of institution of this writ petition. She would have therefore retired from service upon attaining the age of superannuation by now. In that view of the matter, the question of proceeding further pursuant to the impugned showcause notice dated 06.06.2005 does not arise. On that short ground, the writ petition is allowed setting aside the impugned show-cause notice dated 06.06.2005.
