Alleging violation of provisions of Andhra Pradesh Assigned Lands (Prohibition of Transfers) Act, 1977 (for short, 'the Act'), the Tahsildar, Macherla Mandal, Guntur District passed orders on 01.08.2017 and issued further directions to take possession of the land from the petitioner. Aggrieved thereby petitioner preferred appeal before the Revenue Divisional Officer Gurazala Revenue Division, Guntur District. It appears on 24.08.2017 notice was issued for appearance of the parties on 30.08.2017 by the Revenue Divisional Officer.

Learned counsel for the petitioner states that the case was adjourned on two occasions. According to learned counsel along with the appeal, petitioner also filed application for grant of stay of the orders of the Tahsildar. But so far no decision is made on the said stay application.

Since the appeal filed by the petitioner is pending, this Court is not inclined to entertain the writ petition and keep the writ petition pending.

Having regard to the above, the Writ Petition is disposed of granting liberty to the petitioner to prosecute the appeal already filed before the Revenue Divisional Officer. However, since petitioner filed miscellaneous application praying to grant stay of operation of the order of the Tahsildar, the Revenue Divisional
- 3 - Officer is directed to consider the said application and take appropriate decision, as warranted by law, within a period of three
(3) weeks from the date of receipt of copy of this order. Till the decision is made, the petitioner shall not be dispossessed, if he is not already dispossessed. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
