THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.5208 of 2016 ORDER:
The grievance of the petitioner is with regard to the failure on the part of the mining authorities in considering her representation dated 06.02.2016 whereby she sought extension of time for de-casting sand from her patta land admeasuring Ac.2.06 cents in Sy.Nos.193 and 197 of Bommuvanipalem Village, Kollipara Mandal, Guntur District.
The petitioner was granted permission to de-cast sand from her patta lands under proceedings dated 18.01.2016 (wrongly mentioned as 18.01.2015) of the Collector and Chairman, District Level Sand Committee, Guntur. This permission was valid from 12.01.2016 to 31.01.2016. The grievance of the petitioner is that the permission granted was with retrospective effect and effectively denied her the right to de-cast for seven out of the twenty days allowed. In any event, as the petitioner's representation dated 06.02.2016 is pending consideration before the Collector and Chairman, District Level Sand Committee, Guntur, the second respondent, this Court sees no purpose served in entertaining this writ petition and inviting a counter-affidavit.
It is for the authority concerned, the second respondent, to consider the petitioner's representation in accordance with law and take appropriate action thereon. In the event the petitioner's request for extension of time is refused, the reasons therefor shall be recorded and duly communicated to the petitioner. This exercise shall be completed expeditiously and in any event, not later than two weeks from the date of receipt of a copy of this order.
The writ petition is disposed of with the above directions. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
