THE HON'BLE SRI JUSTICE T.AMARNATH GOUD W.P.NO.3052 OF 2006 ORDER:

This writ petition is filed by the petitioners to declare the action of the respondents in interfering with their peaceful possession and enjoyment and also threatening to dispossess them in respect of the land in an extent of Ac.1.06 guntas in Sy.No.86 of Shaikpet village and Mandal of Hyderabad District and demolishing the compound wall constructed on the above land, as arbitrary and illegal.

Heard Ms.K.Krishnaveni, learned Assistant Government Pleader for Revenue (Andhra Pradesh). Since the matter pertains to the year 2006, this Court constrained to proceed with the case and dispose of the same on merits.

It is the case of the petitioners that they are the protected tenants in respect of the lands in Sy.Nos.86, 89 and 90 of Hyderabad village to an extent of Ac.1.06 guntas, Ac.1.19 guntas and Ac.0.38 guntas respectively and that the respondents highhandedly demolished the compound walls constructed by them without following due process of law.

Ms.K.Krishnaveni placed on record the letter dated 23-11-2017 addressed by the Tahsildar, Shaikpet Mandal and made her submissions based on the written instructions, stating that the possession of the subject land has been taken over by the U.L.C. authorities on account of surplus land and the same has been handed over to the Deputy Tahsildar, Golkonda Mandal on

21-5-1999 and since then, the said land has been in possession of the Government.

In view of the above circumstances,, the writ petition is dismissed. No order as to costs. As sequel, the miscellaneous petitions pending if any shall stand closed.
