HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.5316 of 2017 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Home for respondents and perused the prayer in the writ petition with the supporting affidavit and other material on record and the counter affidavit filed on behalf of the respondents by the 7th respondent by name Anand Kumar, who is SHO, Amberpet P.S. no other than 6th respondent herein. The supporting affidavit averment is that the police are unnecessarily interfering with the civil disputes without any manner of right and unconstitutionally.

The counter affidavit averments are that the complaint received from the petitioners and a preliminary inquiry was conducted into and there was no action to be taken thereunder and after intimation GD entry made and the preliminary inquiry conducted revealed as civil nature and matters are pending before the Civil Court and no further action is taken and the contra allegations in the writ petition are untrue.

Having regard to the above, the Writ Petition instead of keeping pending is disposed of directing the police not to interfere with any civil disputes except through due process of law. So far as further investigation is concerned, remedies are left open under law for police.

Consequently, miscellaneous petitions, if any shall stand closed. No costs.
