HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.3533 of 2018 ORDER:

This Criminal Petition is filed by the de-facto complainant under Section 482 Cr.P.C with a request to direct XIV Metropolitan Magistrate Cyberabad at L.B.Nagar in C.C.No. 390 of 2015, expeditiously preferably day to day. The submission of learned counsel for petitioner Sri K. Surender, is that the second respondent/A1 is the resident of USA and if trial is delayed he may go back to USA and may not return and attend for trial and in that view of the matter, a direction may be given to the trial Court to conduct the trial expeditiously.

It is informed that the matter is posted to 27.3.2018 for consideration of the charges.

Having regard to the stage of the matter, liberty is given to the petitioner to move an application before the trail Court seeking for an expeditious trial, in which case, the trial Court may consider the same depending upon the number of matters, particularly old matters pending in that Court, and conduct the trial to suit the convenience of the Court as well as the parties.
