Petitioners complain against seizing Tractor and Trailer bearing Nos.AP22X 8585, AP22X 8584, TS06EE 6508 and TS06EL 8930 as illegal and unconstitutional and seek release of the vehicles in terms of G.O.Ms.No.3 Industries & Commerce (Mines-I) Department dated 08.01.2015 and G.O.Ms.No.15 Industries and Commerce (Mines-I) Department dated 19.02.2015.

On instructions, the Assistant Government Pleader for Home, submits that, on 01.11.2016, in Cr.No.129 of 2016 the subject vehicles have been deposited before the Court of Judicial First Class Magistrate, Narayanpet. Since the vehicles are deposited with the Court of competent jurisdiction, the petitioner has to move the Court for appropriate reliefs.
By granting liberty to file application for release of vehicles, the writ petition is disposed of. Since policy decision is taken in G.O.Ms.No.3 dated 08.01.2015 and G.O.Ms.No.15 dated 19.02.2015 for release of vehicles, the petitioners are given liberty to bring the same to the notice of the Court when their application is considered for release of vehicles. As a sequel, the miscellaneous applications pending, if any, shall stand closed. There shall be no order as to costs. ____________ S. V. BHATT, J November 3, 2016 DSK
