HONOURABLE SRI JUSTICE P. KESHAVA RAO I.A. No. 2 of 2019 AND CRIMINAL REVISION CASE No.1206 of 2014 COMMON ORDER:
Heard the learned counsel for the petitioner and the de facto complainant/respondent No.2.
I.A.No.2 of 2019 is filed by the petitioner/2nd respondent in the revision case to record the compromise entered into between him and the revision petitioner.
Having heard both the counsel and having regard to the averments made in the affidavit filed in support of the application and the joint memo filed by both the parties to the effect that at the intervention of their elders and well-wishers, the matter was compromised between them, the application is ordered.
The petitioner and the 2nd respondent are present in the Court and are identified by their respective counsel. They produced the Xerox copies of the Aadhaar cards and the same are made as part of the record.
In view of the orders passed in I.A.No.2 of 2019, the criminal revision case is allowed, setting aside the judgment in Crl.A.No.255 of 2012 dated 15.05.2014 on the file of the IV Additional Metropolitan Sessions Judge, Hyderabad, confirming the judgment in C.C.No.163 of 2011 dated 14.03.2012 on the file of the XVI Additional Judge, City Civil Court-cum-XX Additional Chief Metropolitan Magistrate at
Hyderabad and the accused is acquitted of the offence punishable under Section 138 of the Negotiable Instruments Act, 1881.
Both the counsel undertook before this Court that for recording the compromise, they will deposit Rs.25,000/- to the Telangana Legal Services Authority within a period of two weeks from the date of receipt of a copy of this order and submit the receipt to the Registrar (Judicial) for taking further action. Failure to comply with the above said direction, this order automatically stands vacated and the Registrar (Judicial) is directed to take appropriate steps for noncompliance of the order.
