This Criminal Petition is filed under Section 480 & 483 of Bharatiya Nagarik Surakhsha Sanhita, 2023 praying this Court to enlarge the petitioners on bail, who are arrayed as accused Nos.2 and 3 in Crime No.61 of 2026 of Luxettipet Police Station, Ramagundam District. The offences alleged against the petitioners are under Sections 179, 180 and 318(4) of BNS.

The brief facts of the case are that, on 27.02.2026 the defacto complainant lodged a report before the police stating that unknown persons poured petrol worth Rs.1,500/- into their car and paid using three fake Rs.500 currency notes bearing identical serial numbers (9FV 230854). Acting on the said complaint, the police registered a case against the accused persons for the relevant offences. During the course of investigation, the petitioners were identified and taken into custody on 28.02.2026. 3.

Heard Sri Dinesh Chakrawarty, learned counsel appearing on behalf of the petitioners and Sri M. Ramachandra Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioners submitted that the petitioners are innocent of the alleged offences and are falsely implicated in the crime and that there is an unexplained delay of two days in lodging the complaint, despite the police station being in close proximity and the complainant allegedly having prior knowledge of the counterfeit nature of the notes. He further submitted that the petitioners were neither present at the scene nor connected with the vehicle allegedly used in the offence and that the petitioners have been in judicial custody since 28.02.2026, and the material part of investigation is completed. Therefore,

prayed this Court to grant regular bail to the petitioners by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the bail petition by stating that the allegations against the petitioner are serious and grave in nature and the investigation is not yet completed. Given the gravity of the offence and the serious nature of the allegations, the petitioners are not entitled to bail and prayed the Court to dismiss the petition.

Considering the submissions made by both the learned counsel and the material available on record, it is evident that the main allegation against the petitioners is that they along with other accused were indulged in fake currency and the petitioners have been in judicial custody since 28.02.2026. As seen from the remand case diary, the prosecution witnesses, LWs. 1 to 14, have already been examined and that accused No.6, who is in similar footing with the petitioners was already granted bail. Taking into account the overall facts and circumstances of the case, progress in the investigation and the period of incarceration, this Court is inclined to grant regular bail to the petitioners, subject to the following conditions:

i.

The petitioners shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five

Thousand only) each with two sureties for a like sum each to the satisfaction of the learned I Additional Sessions Judge, Mancherial.

ii.

The petitioners shall appear before the concerned SHO between 09.00 a.m and 5.00 p.m., on every Wednesday for a period of eight

(8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioners shall abide by the conditions stipulated in Section 483(2) of the BNSS.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
