GANGA RAO Writ Appeal No.1417 OF 2017 Judgment: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) Heard Sri S.V. Munireddy, learned counsel for the appellants, and the learned Government Pleader for Home and, with their consent, the writ appeal is disposed of at the stage of admission. This appeal, under Clause 15 of the Letters Patent, is preferred against the interlocutory order passed by the learned Single Judge in W.P.M.P. No. 37770 of 2017 in W.P. No. 32099 of 2017 dated 11.9.2017. The complaint of the appellants-writ petitioners before the learned Single Judge was that the police officials were interfering with their possession at the behest of the 6th respondent, and were preventing them from carrying on agricultural operations.

While the inter-se disputes between the appellants on the one hand, and the 6th respondent on the other, are required to be examined in properly constituted Civil proceedings before the competent Court of Civil jurisdiction, Sri S.V. Munireddy, learned counsel for the appellants, would point out, rightly so, that the 5th respondent cannot, at the behest of the 6th respondent, interfere with the appellants' possession over the subject land.

When the appeal came up for admission yesterday, learned Government Pleader for Home sought time to obtain instructions. Today, she states that, while a crime has been registered against the appellants herein for trespass and the matter is under investigation, the 5th respondent would only proceed with the investigation, and not interfere with the appellants-writ petitioners' possession over the subject land or with their carrying on agricultural operations thereon.

Sri S.V. Muni Reddy, learned counsel for the appellants, states that it would suffice if the statement of the learned Government Pleader is recorded, and the Writ Appeal is closed.

Recording the submission of the learned Government Pleader for Home, that the 5th respondent would not interfere with the appellantswrit petitioners' possession over the subject land or prevent them from carrying on agricultural operations thereat, the Writ Appeal is closed. Miscellaneous Petitions pending, if any, shall also stand closed. There shall be no order as to costs.
