This writ petition, filed under Article 226 of the Constitution of India, challenges the order passed by the Revenue Divisional Officer, Adoni - 3rd respondent herein vide proceedings Rc.(M).No.708/2015, dated 28-05-2015. Heard, Sri M. Ramalingeswara Reddy, learned counsel for the petitioner and learned Government Pleader for Civil Supplies for respondents.
According to the petitioner, he was appointed as a fair price shop dealer of shop No.48, Adoni town and mandal, Kurnool District by the 3rd respondent in the year 2007 on regular basis and the same was renewed from time to time till it was cancelled by way of impugned order.
The Revenue Divisional Officer - 3rd respondent herein, issued a show cause notice, dated 19-05-2015 calling upon the petitioner as to why the authorization of the petitioner should not be cancelled. In response to the same, the petitioner herein submitted his explanation on 22-05-2015 and eventually the Revenue Divisional Officer - 3rd respondent herein passed the order under challenge on 28-05-2015.
According to the petitioner, he filed an appeal before the 2nd respondent on 06-01-2017 and no orders have been passed on the said appeal.
Since the petitioner herein has filed a regular statutory appeal before the appellate authority, this Court deems it appropriate to dispose of the present writ petition by directing the appellate authority to pass appropriate orders on the said appeal, in accordance with law, by fixing some time frame. For the aforesaid reasons, the writ petition is disposed of, directing the 2nd respondent to pass appropriate orders on the appeal, dated 06-01-2017 said to have been preferred by the petitioner herein against the order of cancellation, dated 28-05-2015, in accordance with law, within a period of three
(3) months from the date of receipt of a copy of this order, after giving notice and opportunity of being heard to the petitioner herein.
Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
