THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION NO. 32654 OF 2011 ORDER:

Heard the learned counsel for the petitioner as well as the learned Additional Standing Counsel appearing for respondent No.1.

The prayer sought in the Writ Petition is as under: " ...to issue a writ or order or direction preferably writ of mandamus declaring the letter dt.15.6.2010 issued by the respondent No.1 despite recommendation of Eminent Freedom Fighters Committee sent in the month of Feb,2010 for grant of pension under Swatantrata Sainik Samman Pension Scheme, 1980 as illegal, arbitrary and violative of principles of natural justice and consequently direct the respondent no. 1 to consider the claim of the petitioner for grant of pension as per the scheme without reference to the impugned letter dt. 15.06.2010 issued by the respondent No.1." 3.

During the course of arguments, learned counsel appearing for the petitioner placed on record, the proceedings No.112/ 614/ 82-FF (HC) dated 8.6.2012, wherein it is stated that the case of the petitioner has been considered and rejected on the ground that she has not furnished any documentary evidence in support of her claim for Swatantrata Sainik Samman Pension on account of her deceased husband's sufferings in the freedom struggle .

In the light of the above, no further cause would survive in the present Writ Petition.

Accordingly, the Writ Petition is dismissed.

It is needless to observe that if the petitioner is aggrieved by proceedings dated 8.6.2012, she is at liberty to challenge the same in appropriate proceedings, if so advised.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
