This writ petition is filed seeking writ of mandamus declaring the action of the respondents in not resuming the land admeasuring Acs.3.21 guntas in Sy.Nos.496/2A, 496/3A, 496/4A and 496/1A2 situated at Avilala Village, Tirupati Urban Mandal as the beneficiaries have violated the conditions of allotment stipulated in R.O.C.No.A/661/08, dated 06.08.2008 issued by the 5th respondent as illegal and arbitrary and consequently to direct the respondents to resume the said land as per the report submitted by the 5th respondent vide Roc.A/599/2006, dated 22.07.2014.

2. Heard both sides.

3. Since the affected parties from whom the land is to be resumed are not made as parties in the writ petition, this writ petition is liable to be dismissed on the ground of non joinder of proper and necessary parties.

Accordingly, this writ petition is dismissed. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending, shall stand dismissed.
