O R D E R

This Criminal Petition is filed under Section 482 of BNSS for grant of pre-arrest bail to the petitioner, who is arrayed as accused No.2 in Crime No.873 of 2025 on the file of the Uppal Police Station, Rachakonda Commissionerate, registered for the offences punishable under Sections 108, 318(4), r/w 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for short 'BNS').

The case of the prosecution is that the de-facto complainant, lodged a report before the police on 20.07.2025 stating that her husband, Gummadavelli Srinivasu, was made

as guarantor for a chit. A.1 took the chit amount, but failed to repay the same and the burden imposed on her husband. It is further stated the they borrowed approximately Rs.10,00,000/- from the husband of the complainant and did not repay the same and when they asked the same, the accused harassed them mentally and physically. On 20.07.2025 at about 4:45, when her husband was going for a walk and he did not return. Later the police informed her that her husband committed suicide by hanging himself at SC Community hall was found dead and requested the police to take necessary action against accused Nos.1 and 2. Basing on the same, police registered a case for the aforesaid offences. 3.

Heard Sri Vijay Kumar, learned counsel for the petitioner and Sri M. Ramachandra Reddy, learned Additional Public Prosecutor appearing for the respondent - State. 4.

Learned counsel for the petitioner submitted that the petitioner is no way connected with the offences alleged against the petitioner; that there is no allegation against the petitioner that he has abetted the deceased to commit suicide. He further submits there is no averment against the petitioner

or no acts have been committed which amounts to abatement of the alleged offences. Therefore, he prayed the Court to grant pre-arrest bail to the petitioner by allowing this criminal petition.

On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, contending that the allegations levelled against the petitioner are serious in nature. Therefore, he prayed this Court to dismiss the criminal petition.

In light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner is due certain amount to the husband of the de-facto complainant, however, the complaint contains there is no specific averment against the petitioner, and no suicide note has been recovered from the deceased implicating the petitioner in any manner. Considering the facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioner, subject to compliance of the following conditions:

i.

The petitioner-accused No.2 shall surrender before the Station House Officer, Uppal Police Station, Rachakonda Commissionerate, within two (2) weeks from today, and on such surrender, the said Station House Officer shall release him on bail, on petitioner executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties, for the like sum each.

ii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case. iii.

The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
