HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Crl.P.M.P.No.1462 of 2015 in Crl.P.No.1354 of 2015 and Criminal Petition No.1354 of 2015 COMMON ORDER:

Defacto complainant and her father-K.Ramaswamy along with their counsel Sri T.Basaviah are present. Accused and his counsel Sri Ch.Anjaneyulu are present. On the report given by defacto complainant the police of Karimnagar Rural PS registered FIR No.368 of 2014 and investigated into the matter and laid charge sheet against the accused for the offence under Section 354-D (1) IPC and learned Additional Judicial first Class Magistrate, Karimnagar took cognizance of the same and registered as C.C.No.1448 of 2014 The allegation is that accused who is a tenant in the house of uncle of complainant allegedly misbehaved with the complainant in an indecent manner.

Now, both the parties along with their counsel present in the Court today and submitted that at the intervention of elders they have amicably resolved their disputes and they want to live in a peaceful and harmonious manner and defacto complainant and her father have no threat or inconvenience as against the accused and therefore, they have no objection for quashment of proceedings and hence Court may be pleased to permit them to compound the offence and proceedings may be quashed accordingly in the interest of justice.

Having regard to the above submission and in view of the fact that allegations levelled against the accused are not grave ones and considering the fact that both are neighbours and now they are leading peaceful and harmonious life and there is no threat from the accused to the complainant and no useful purpose will be served if they are driven to trial, and following the decision reported in Gian Singh v. State of Punjab and another[1] this petition is allowed and permission is accorded to the parties to compound the offence and proceedings in C.C.No.1448 of 2014 on the file of Additional Judicial first Class Magistrate, Karimnagar are hereby quashed in the terms of joint memo filed by the parties.

In the result, both the petitions are accordingly allowed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
