THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.3670 of 2012 ORDER:

Heard Sri K.Suresh Kumar Reddy for petitioner, Sri G.Seshadri for 1st respondent and the Assistant Government Pleader for Revenue for 3rd respondent.

The petitioner prays for Mandamus declaring the action of respondents in threatening to demolish house bearing Nos. 4-431 and 4-499 at Sodam Village, Chittoor District, without recourse to law, as illegal, arbitrary and unconstitutional. On 13-02-2012, the possession of petitioner of subject matter of writ petition is protected by interim order and the order is subsisting as on date.

I have perused the affidavit and annexures filed in the writ petition and also the stand taken by respondents 1 and 3. Without expressing view on the merits of the fact in issue between the parties, bearing in view the possession of petitioner of either house bearing Nos. 4-431 and 4-499 or the village site poramboke, I am satisfied the writ petition can be disposed of by this order.

The possession of petitioner of house bearing Nos. 4-431 and 4-499 or the village site poramboke allegedly in possession of petitioner shall not be disturbed except

in accordance with law. The respondents are given liberty, if necessary, to issue notice and pass orders in accordance with law.

The writ petition is disposed of accordingly. No order as to costs.
