THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.18187 of 2006 ORDER:

1. This writ petition is filed seeking to declare the action of the 1st respondent in not considering the petitioner's application vide File No.112/2958/1997 and in not sanctioning the Central Pension under Swatantra Sainik Sanman Pension Scheme, as illegal and arbitrary and consequently, to direct the 1st respondent to sanction Central Pension to the petitioner.

2. Heard and perused the material available on record.

3. Considering the fact that the 1st respondent has received the application of the petitioner herein, this Court is of the view that necessary direction can be given to the 1st respondent.

4. Accordingly, the 1st respondent is directed to pass appropriate orders after scrutinizing the application, which is pending vide File No.112/2958/1997, and other relevant documents forwarded by the petitioner.

5. With the above direction, the Writ Petition is disposed of. Consequently, the miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
