The petitioners, who are A.1 to A.4 in Calendar Case No.509 of 2016 on the file of the Judicial Magistrate of First Class, Tadipatri, Anantapuram District, filed the present application under Section 482 of the Code of the Criminal Procedure (Cr.P.C.) seeking to quash the NonBailable Warrants (N.B.Ws) issued against the petitioners by the learned Judicial Magistrate of First Class, Tadipatri, Anantapuram District, in the above mentioned case.
The 2nd respondent herein filed a private complainant before the Judicial Magistrate of First Class, Tadipatri, which was referred to the Police under Section 156(3) Cr.P.C., for investigation. Police after investigation filed charge sheet and the same was numbered as Calendar Case No.509 of 2016. As the petitioners failed to appear before the Investigating Officer for the purpose of investigation, the Court below issued N.B.W. against them.
Having regard to the circumstances of the case, N.B.Ws issued against the petitioners in Calendar Case No.509 of 2016 on the file of the Judicial Magistrate of First Class, Tadipatri, Anantapuram District, is stayed for a period of two (02) weeks from today. Meanwhile, the petitioners shall appear before the Judicial Magistrate of First Class, Tadipatri, Anantapuram District and move an application for bail after giving prior notice to the learned Public Prosecutor, in which event, the petitioners shall be released on bail on their executing a personal bond
for a sum of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties for a like sum each to the satisfaction of the same Court. Further, the petitioners shall appear before the Court below on every date of adjournment without fail.
Accordingly, the Criminal Petition is disposed of. Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed. ___________________________ JUSTI CE C. PRAVEEN KUMAR Date:06.10.2016 INL
