THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.2919 OF 2022 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner, who is arrayed as accused No.1, to grant anticipatory bail in the event of her arrest in connection with Crime No.31 of 2022 of Suryapet-II Town Police Station registered for the offences punishable under Section 306 read with 34 of of Indian Penal Code.

Heard the learned counsel appearing for the petitioner/accused, and the learned Assistant Public Prosecutor appearing for the respondent-State and perused the record. 3.

The petitioner is the wife of the deceased. It is alleged in the complaint the petitioner harassed her husband for various reasons, which ultimately lead to commission of suicide by the deceased. The learned Counsel for the petitioner filed medical certificated dated 03.03.2022 which reflects that the petitioner is four months pregnant, which is not disputed by the prosecution.

In the circumstances, the petitioner, being pregnant, any detention may have an adverse impact on her medical condition for which reason the petitioner can be granted relief of anticipatory bail. The Criminal Petition is accordingly allowed and the petitioner/Accused No.1 is granted anticipatory bail subject to the following terms and conditions:

(1) The petitioner/Accused No.1 is directed to surrender before the Station House Officer, Suryapet-II Town Police Station, within a period of (15) days from the date of this order and on such surrender, the petitioner is directed to be released on bail on her executing a personal bond to the tune of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties to the like sum each to his satisfaction.

(2) The petitioner/Accused shall abide by the other conditions stipulated in Section 438(2) Cr.P.C and co-operate with the Investigating Officer in investigating the case.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
