THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 31076 OF 2017 O R D E R:

This Writ Petition is filed by the Andhra Pradesh Private Multi-purpose Health Workers (Female) Training Institutions Association seeking a direction to the 2nd respondent Commissioner of Family Welfare to consider the representations dated 31.07.2017 and 08.08.2017 made for inclusion of the institutions in the admission notification for the academic year 2017-18 for allocating the students to undergo Multi-purpose Health Workers (Female) Training Course (2 years), pursuant to the notification dated 14.07.2017.

Heard learned counsel for the petitioner as well as learned Government Pleader for Medical, Health & Family Welfare (Andhra Pradesh).

As can be seen from the affidavit filed in support of the Writ Petition, the grievance of the petitioner is that some of the constituent members have not been allotted students on the ground that they have not satisfied the requirements, as mandated, for grant of permission for running a school. The requirements that are to be satisfied have been set out, in detail, in G.O.Ms. No. 99, Health, Medical & Family Welfare (K2) Department, dated 26.05.2014. As the Writ Petition is filed by the Association, it is not possible for this Court to come to a conclusion that which of the members of the Association have and / or which of them have not fulfilled the conditions laid down in G.O.Ms.No. 99.

In those circumstances, interests of justice would be served if liberty is given to the individual members of the Association to set out, in detail, their grievances. As and when such issues come up before the 2nd respondent, the same shall be considered in accordance with law.

The Writ Petition is disposed of. No costs.

Consequently, the miscellaneous Applications, if any shall stand closed.
