THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.37057 of 2016 ORDER:

The petitioners complain against seizure of M/ s.Someswara Oil Mill and M/ s.Lakshmi Fried Gram Mill in the same premises without reference to law as illegal and unconstitutional. The further grievance is that the rice seized under panchanama dated 25-10-2016 cannot be unilaterally treated as PDS rice with the broken content and the petitioners request the court to make representation to 2nd respondent for release of seized stock.

Learned Government Pleader, on instructions, admits that the premises of M/ s.Someswara Oil Mill and M/ s.Lakshmi Fried Gram Mill has been kept under lock and key by respondents 2 and 3 and the same cannot be sustained in law. He further assures the Court that while taking proper steps for protecting seized rice, respondents 2 and 3 will forthwith remove the seizure of premises effected by them.

The statement is placed on record and accordingly the needful is done by today evening.

The petitioner is given liberty to represent to 2nd respondent for release of seized stock within one week from today by enclosing a copy of this order. As and when such a request for release of

stock is made, the 2nd respondent is directed to pass orders, in accordance with law, within a further period of two weeks. The writ petition is disposed of accordingly. No order as to costs.
