HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.17872 of 2015 ORDER:

Heard the learned counsel appearing for the petitioner, learned Government Pleader for Panchayat Raj & Rural Development (AP), Sri MSR Chandra Murthy, learned special counsel for respondents 2 to 4 and Sri G.Seshadri, learned counsel for the 5th respondent.

2. According to the petitioner, he was selected as Field Assistant of Chilakapadu Village, Santhanuthalapadu Mandal, Prakasam District on 01.06.2009 and since then he has been working as such without any complaint from the job card holders or the authorities. While so, the 3rd respondent issued a show cause notice dated 08.08.2014 to the petitioner making certain allegations, for which he submitted explanation. The case of the petitioner is that without considering his explanation or conducting any enquiry, the 3rd respondent issued impugned proceedings dated 24.02.2015 permanently removing the petitioner from the post of Field Assistant. Learned counsel appearing for the petitioner submits that the allegations made against the petitioner are not serious, but only vague and general in nature. In any event, the petitioner filed an appeal before the 2nd respondent and the same is pending.

3. Under these circumstances, the 2nd respondent is directed to dispose of the appeal filed by the petitioner within a period of eight (8) weeks from the date of receipt of a copy of this order, after affording opportunity of personal hearing to the petitioner.

4. The writ petition is accordingly disposed of. Miscellaneous applications, if any, in this writ petition shall stand closed. No order as to costs.
