HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.3603 of 2018 ORDER:
In this petition filed under Section 482 Cr.P.C., the petitioner/accused seeks to quash the proceedings against him in Cr.No.12 of 2018 of A.S.Pet PS., Sri Potti Sri Ramulu Nellore District registered for the offences under Section 354(a), 354(ii) IPC and Section 3(1) (r), 3(1)(w)(ii) of SCs. and STs. (POA) Act, 1989.
2) Denying the allegations, learned counsel for petitioner submits that petitioner is an ex-Sarpanch and the de-facto complainant is now working as Jammavaram Society Bandham President and there are political differences between both of them due to which she filed a false case against him. On this submission he sought to quash the proceedings. 3) As per learned Additional Public Prosecutor, investigation is still in nascent stage. Having regard to prima facie accusation, it is not a fit case to quash the proceedings. Hence, investigation shall be continued. However, the Investigating Officer shall strictly follow the procedure contemplated under Section 41A Cr.P.C. during the course of investigation and the petitioner/accused in his turn, shall cooperate with the investigating agency for smooth completion of investigation.
4) Criminal Petition is accordingly disposed of. As a sequel, miscellaneous applications pending, if any, shall stand closed.
