HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 12155 of 2016 ORDER:
Heard learned counsel for the petitioner and Government Pleader for Transport. With the consent of both the parties, the writ petition is taken up for disposal at the admission stage itself. The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondents 2 and 3 in keeping the petitioner's Lorry bearing No. AP 24 Y 7022 in black list and not granting vehicle permit cancellation from Medak District and clearance certificate to transfer the same to Attapur of Ranga Reddy District R.T.O.
Learned counsel for the petitioner submits that though the petitioner an application in the month of March, 2016 seeking cancellation of Part-A & B in respect of vehicle No.AP 24 Y 7022, till date the same is not disposed of.
Government Pleader for Transport would submit that having regard to the exchange of legal notices there appears to be some dispute, hence the authorities summoned the petitioner as well as the rival claimant to the office for settlement of the dispute with regard to the said vehicle.
Having regard to the facts and circumstances of the case, if the application made by the petitioner is still pending consideration, the respondent authorities shall pass orders, in accordance with law, as expeditiously as possible, preferably within a period of three (03) weeks from the date of receipt of a
copy of the order, after hearing the petitioner as well as rival claimant. No order as to costs.
Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
