THE HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND THE HON'BLE SRI JUSTICE G. SHYAM PRASAD WRIT PETITION No.25001 OF 2006 ORDER: (Per Hon'ble Sri Justice V. Ramasubramanian) This writ petition is by the State of Andhra Pradesh challenging an order of the Andhra Pradesh Administrative Tribunal, directing the petitioners to consider the cases of the respondents, for the grant of the benefit of re-fixation of pay as per a Government Order. Heard the learned Government Pleader for Services-I. By the order impugned in the writ petition, the Tribunal has merely directed the petitioners to consider the cases of the respondents, in accordance with a Government order, in the light of a decision of this Court. There was no positive direction from the Tribunal. Therefore, it is always open to the petitioners to take a view that is permitted by law. Such a direction need not be challenged in a writ petition, as the hands of the petitioners are not fettered by the order of the Tribunal. Hence, the writ petition is dismissed.
