HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.45 of 2015 ORDER:

This petition is filed to withdraw F.C.O.P.No.1689 of 2014 from the file of Additional Family Court, Visakhapatnam, and transfer the same to Senior Civil Judge, Amalapuram, East Godavari District.

2. Wife filed this petition contending that due to disputes, she is now living at Amalapuram with her parents. She contended that she cannot travel from her native Village Kormargiripatnam to Visakhapatnam for the purpose of defending F.C.O.P.No.1689 of 2014 filed by respondent herein. It is contended in view of distance between these two places she has to necessarily start one day before to go to Visakhapatnam and it will be difficult for her to undertake such journey and for that reason, she prayed for transfer of F.C.O.P.No.1689 of 2014 from Visakhapatnam to Amalapuram.

3. Respondent filed counter disputing the affidavit averments of petitioner and contended that it is difficult for him to go to Amalapuram from Visakhapatnam and the same inconvenience would be caused to him and that he has to start one day before for reaching Amalapuram.

4. Heard both sides.

5. Both side advocates submitted their arguments supporting the contentions of their respective clients.

6. I have perused the affidavit of petitioner and counter-affidavit of respondent. Considering the affidavit and counter-affidavit of both parties, I feel that the request of wife can be considered by transferring F.C.O.P.No.1689 of 2014 from Additional Family Court, Visakhapatnam to Family Court, East Godavari at Rajahmundry.

7. Accordingly, F.C.O.P.No.1689 of 2014 is withdrawn from Additional

Family Court, Visakhapatnam, and transferred to Family Court, East Godavari at Rajahmundry, for disposal in accordance with law, by considering the convenience of both parties.

8. Accordingly, transfer C.M.P. is ordered. No costs.

9. Miscellaneous Petitions pending, if any, shall stand dismissed. __________________ S. RAVI KUMAR, J 9th April 2015.
