THE HON'BLE SRI JUSTICE P. NAVEEN RAO CONTEMPT CASE No.1480 OF 2017 ORDER:

While rejecting the prayer in W.P.M.P.No.9787 of 2017 in W.P.No.7935 of to adjust the petitioner in any supernumerary post or else pay the salary drawn by the petitioner from the date of declaring him unfit for the post of driver, it was observed that it was open to the petitioner to apply for additional monetary benefit and filing of such application and receiving the amount would be without prejudice to his claim in the Writ Petition.

Learned counsel for the petitioner now alleges that the said observation is violated and monetary benefit is not paid to the petitioner.

Prima facie, a reading of the order makes it clear that the prayer of the petitioner was rejected; the W.P.M.P.No.9787 of 2017 was dismissed and only liberty was granted to the petitioner to apply for additional monetary benefit and no direction was issued. Thus, it cannot be said that there is disobedience warranting initiation of contempt proceedings.

However, learned standing Counsel for the respondent - Corporation fairly submits that the issue of payment of monetary benefit to the petitioner is under process.

The Contempt Case is accordingly closed.
