THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.9528 of 2018 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking the following relief: "For the reasons stated in the accompanying affidavit the petitioners prayed that this Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of 3rd respondent in registering F.I.R No: 27/2018 on its file for the offence under section 498 of Indian Penal Code and contemplating to arrest him pursuant there to, as illegal, irregular, without any authority of law and violative of provisions of the code of criminal procedure and offends Articles 14 and 21 of Constitution of India and consequently direct the respondents 1 to 3 to close the said F.I.R without undertaking any further investigation pursuant thereto and pass such other order or orders as the Hon'ble Court may deem fit and proper in the circumstances of the case." Heard Sri Borra Siva Sankara Rao, learned counsel appearing for the petitioner and the learned Government Pleader for Home (A.P.) appearing for the respondents 1 to 3.

After the submissions are heard for some time, learned counsel for the petitioner sought permission to withdraw the writ petition and sought liberty to file a fresh appropriate writ proceeding. 4.
Having regard to the submissions, permission is accorded to withdraw the writ petition.

Accordingly, the Writ Petition is dismissed as withdrawn reserving liberty to the petitioner to file an appropriate writ proceeding, if the petitioner is so advised. There shall be no order as to costs.
MSRM, J W.P.No.9528 of 2018 Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
