THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WP.No.13425 of 2016 ORDER :

Heard the counsel for petitioner, and the learned Government Pleader for Revenue (Andhra Pradesh) for respondents.

The petitioner's grievance is that he is the owner of Acs.2.30 cents in Survey No.170-2, situate at Alamuru Village, Anantapuram Mandal, Anantapuram District; and that he intended to sell the said land to some third party, but the 4th respondent is not receiving the document for the purpose of registration.

The learned Government Pleader for Revenue (Andhra Pradesh), appearing for respondents, states that the 4th respondent would receive the document presented by petitioner; and if he does not wish to register it, he will pass orders under Section 71 of the Indian Registration Act, 1908 (for short, 'the Act') giving reasons why he does not wish to register the said document.

4. In view of the said submissions, the Writ Petition is disposed of directing 4th respondent to receive the document presented by petitioner, if submitted by petitioner within a period of two (02) weeks from the date of receipt of a copy of the order; and if the 4th respondent

does not wish to register it, he shall pass an order stating why he does not wish to register under Section 71 of the Act within a period of eight (08) weeks thereafter, and communicate his decision thereon to petitioner. No order as to costs.
