HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.7192 of 2017 ORDER:

This writ petition is filed seeking writ of mandamus declaring the inaction of the 2nd respondent in issuing notice for the purpose of conducting enquiry in B2/636/2013, dated 16.11.2015 in respect of Sy.Nos.92 and 93, situated at Kandikalgate, Bandlaguda Mandal, Hyderabad, despite pendency of CCCA No.3/2012 on the file of this Court and also pendency of orders passed in CCCA MP No.15/2012, dated 06.01.2012 as illegal and arbitrary.

It is the case of the petitioners that the unofficial respondents i.e., 4th and 5th respondents filed appeal before the 2nd respondent against orders dated 06.10.2012 in case No.B/1902/2009 and the petitioners filed implead in the said appeal. Thereafter, notice was issued to the 2nd respondent. That though the petitioners are parties before the Revenue Divisional Officer in order dated 06.10.2012, without making them as parties, the unofficial respondents filed appeal. In spite of filing implead petition, the 2nd respondent is not passing any orders on the same. Aggrieved by the same, present writ petition is filed.

Heard learned counsel for the petitioners and learned Assistant Government Pleader for Revenue.

Learned Assistant Government Pleader for Revenue, on instructions, submits that the application filed by the petitioners is pending.

In view of the same, it is for the 2nd respondent to consider the said implead application, in accordance with law.

Hence the 2nd respondent is directed to consider the implead petition filed by the petitioners, in accordance with law, if the same is in order, and dispose of the same, after issuing notice to the petitioners as well as respondents in the said petition.

Accordingly, this writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, shall stand closed.
