HON'BLE SRI JUSTICE A. SHANKAR NARAYANA WRIT PETITION No.10596 of 2007 ORDER :

The instant writ petition is filed seeking Mandamus, declaring the action of the respondents in not seeking the call letters along with others to the interviews scheduled to be conducted from 25.05.2007 to the post of Junior Lineman, Operation Circle, erstwhile Northern Power Distribution Company of Andhra Pradesh Limited (A.P.N.P.D.C.L.), Warangal District, thereby depriving the petitioner's Constitutional right for consideration, as illegal and arbitrary, and consequently, sought a direction to the respondents to conduct interview to the petitioner to the post of Junior Lineman, Operation Circle, A.P.N.P.D.C.L., Warangal District. 2.

Perused the contents of affidavit filed in support of the writ petition.

As per the averments in the affidavit, the Notification dated 06.06.2006, was issued for recruitment to the post of Junior Lineman on yearly contract basis. It appears that when the interview was scheduled to take place on 17.04.2007, the petitioner made a request to conduct interview on some other date, on the ground that he was unwell, which was refused. Hence, the present writ petition. 4.

While admitting the writ petition, by order dated 16.05.2007, in WPMP.No.13338 of 2007, this Court gave an

ASN,J W.P.No.10596 of 2007 interim direction to the respondents to consider the case of the petitioner for the post of Junior Lineman along with others, as per law.

Today, when the matter is called for hearing, there is no representation for the petitioner.

Since the recruitment was on yearly contract basis, the cause in the writ petition does not survive for adjudication and the writ petition has become infructuous. 7.

Accordingly, the writ petition is dismissed as infructuous. Interim order dated 16.05.2007 stands vacated. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
