THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.2968 of 2022 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner-accused No.1, for grant of anticipatory bail in the event of his arrest in connection with Crime No.111 of 2022 of Pet Basheerabad Police Station, Cyberabad, registered for the offence punishable under Section 307 red with 34 I.P.C.

Heard the learned counsel for the petitioner-accused No.1 learned Assistant Public Prosecutor, appearing for the respondent-State and perused the record.

The petitioner is arrayed as accused No.1 in the aforesaid crime. In the scuffle between the two parties, the members of both parties received injuries including this petitioner. Case and counter cases were filed vide the present crime and Crime No.112 of 2022. The petitioner was treated as inpatient for a period of one week. In the remand report, it is not specifically averred that this petitioner caused injuries. However, in the quarrel between the groups, it is stated that the petitioneraccused No.1 received injuries and he was hospitalized. All other accused were arrested and released on bail.

In the said circumstances, the petitioner-accused No.1 is also directed to be released on bail under Section 438 of Cr.P.C on some conditions.

The Criminal Petition is therefore, allowed. The petitioner-accused No.1 shall surrender before the Station House Officer, Pet Basheerabad Police Station, Cyberabad, in connection with Crime No.111 of 2022 within one week from today and on such surrender and executing a personal bond for Rs.20,000/- (Rupees Twenty Thousand only) with two sureties for a like sum each to the satisfaction of the said Station House Officer, he shall be released on bail. After release, the petitioner-accused No.3 shall appear before the said Station House Officer on Tuesday and Saturday of every week between 10:00 and 12:00 Noon for a period of three (3) months or till filing of charge sheet, whichever is earlier. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
