M/S. Jai Santosh Service Station, v. The Hindustan Petroleum Corporation Ltd.,

HON'BLE SRI JUSTICE S.V. BHATT W.P.No.1312 of 2015 ORDER:

Petitioner prays for Mandamus declaring the action of respondents in repeatedly issuing reminder notices for compliance with the objections stated in the notices and in default threatening to stop supply of Petroleum and ancillary products to the petitioners, as illegal, arbitrary and unconstitutional.

Heard learned counsel for the petitioner and Mr.B.Mayur Reddy, learned standing counsel for HPCL.

In the case on hand, one of the assertions of petitioner is that in spite of furnishing the required information, the respondents are threatening to stop supply of Petroleum and ancillary products to the petitioner and these threatened actions are arbitrary and unconstitutional.

Learned standing counsel while joining issue with this assertion of the petitioner alternatively submits that in similar circumstances this Court with a view to give last opportunity to the Dealer/Petitioner herein, granted time in W.P.No.40536 of 2014 to comply with the requirements pointed out by the Corporation.

Having regard to the alternative submission, the writ petition is disposed of by granting time to petitioner till 31.03.2015 to comply with and/or submit the documents requested by the Corporation. As the time is extended by this Court, it is needless to observe that for non-supply of required documents/information, the respondents shall not stop supplying Petroleum and ancillary products to petitioner in the meantime.

Writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
