Heard the learned counsel for the petitioner and the learned Public Prosecutor.

2. The present Criminal Petition came to be filed by the petitioner/A.33 under Section 438 Cr.P.C., seeking release in the event of his arrest in Crime No.46 of 2014 of Eluru Rural Police Station, West Godavari District, registered against him and others for the offences punishable under Sections 143, 150, 153, 188, 332, 307 and 149 of the Indian Penal Code, 1860.

3. Learned counsel for the petitioner submits that the other accused were arrested and released on bail. He also relies on the order dated 17.07.2014 in Criminal Petition No.7755 of 2014 passed by this Court, wherein this Court considered the request of A28 to A32 in the aforesaid crime for grant of anticipatory bail.

4. Learned Public Prosecutor opposes the same.

5. A perusal of the material on record would show that the accused, who were granted anticipatory bail in Criminal Petition No.7755 of 2014, were all women and in the peculiar circumstances of the case, this Court

considered their request. The case of the petitioner does not stand on the same footing for granting the anticipatory bail. Insofar as the other accused are concerned, it is stated by the learned counsel that they were arrested and released on bail. Considering the said fact, the petitioner is directed to appear before the Special Judicial Magistrate of First Class, Eluru within a period of 10 days from today and file an application for bail, in which event, the learned Magistrate shall consider the same on the same terms and conditions as that of the other accused.
