Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed herein, the High Court may be pleased to issue an appropriate writ, order or direction more particularly one in the nature of Mandamus declaring the action of the 2nd respondent in dismissing the appeal filed by the petitioner for the assessment year 2010-11 under APVAT Act 2005 through the impugned proceedings Dt.
29-10-2014 while upholding the levy of purchase tax by the 1st respondent on the turnover of cotton de oiled cake dispatched to other States on consignment transfers invoking power under Section 4(4) of the AP VAT Act, and set aside the same and consequently set aside order of the 1st respondent Dt.30-3-2013 in Form 305 against which the petitioner filed appeal before the 2nd respondent. The petition coming on for hearing, upon perusing the Petition and the affidavit filed herein and upon hearing the arguments of Sri Bhaskar Reddy Vemireddy, Advocate for the Petitioner and G.P.
It is submitted by the learned Government Pleader that they are intending to move review petition seeking review of the judgment in batch of cases connected to this Writ Petition.
Post after three weeks.
Pending further orders, no coercive steps shall be taken for collecting the disputed tax.
