THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.26920 OF 2013 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking to declare the inaction on the part of the respondent in considering the appointment of the petitioner in Andhra Bank on compassionate grounds in lieu of death of his father, as illegal and arbitrary.

It is the case of the petitioner that his father Yerrabadi Koteshwar Rao died in an accident on 01.11.2012 while working as security guard in respondent-bank. As such, the petitioner requested the respondent for providing employment to him in the bank on compassionate grounds. It is stated that though the respondent processed the pension papers of his father, did not take steps for considering his request for appointment on compassionate grounds. Said inaction on the part of the respondent led to filing of the present writ petition. Heard the learned counsel for the petitioner. No representation on behalf of the respondent. Though various grounds are raised in the writ petition, the learned counsel for the petitioner restricts his prayer seeking a direction to the respondent to consider the representation made by the petitioner for providing employment on compassionate grounds. He further submits that in similar circumstances in W.P.No.22498 of 2013 vide order dated 30.07.2013, this Court granted similar relief in favour of the petitioner therein.

Having regard to the above, this Writ Petition is disposed of directing the office of the respondent-Andhra Bank to dispose of the representation said to have been made by the petitioner in the month of December, 2012, if not already disposed of, in accordance with law at the earliest, preferably within a period of three months from the date of receipt of a copy of this order.
