HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 40456 of 2012 ORDER:
Heard learned counsel for the petitioner and Government Pleader for Revenue. With the consent of both the parties, the main writ petition is heard at the admission stage itself.
The present writ petition came to be filed seeking issuance of writ of mandamus declaring the order passed by the first respondent in R.P.No.D1/4834/2005, dated 24.04.2012 confirming the orders passed by the second respondent in Appeal No.D/56/2002, dated 24.11.2003, as illegal, arbitrary and unilateral; and consequent to set-aside the same. At the time when the matter is taken up for hearing, it is brought to the notice of the Court that O.S.No.1 of 2004 filed by the respondents is pending trial before the Junior Civil Judge, Manthani.
In view of the above, the writ petition is disposed of, advising the Junior Civil Judge, Manthani to dispose of O.S.No.1 of 2004 in accordance with law at the earliest. Both the parties are directed to agitate their rights before the said Court. No order as to costs.
Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
