THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.9600 of 2018 ORDER:

Heard learned counsel for the petitioner, learned Government Pleader for Panchayat Raj and Sri G.Seshadri, learned Standing Counsel for the second respondent. When the mater is taken up, written instructions, furnished by the Panchayat Secretary, Gramapanchayat, Ramavarappadu, are placed on record by the learned Standing Counsel. The said instructions read as under: 1.

The subject road situated in the private land and the same belongs to petitioner.

2.

The Gram Panchayat never interfered and never objected the petitioner to occupy and to enjoy the said road treating the same as his own property.

3.

The Gram Panchayat already withdraw the writ appeal as there is no claim against the said land and also the Gram Pancdhayat is not in a position to pay the compensation to retain the said road.

4.

If the petitioner occupy and protect said property the Gram Panchayat will not interfere as we have no claim against the said property. 5.

If the petitioner ready to pay the costs of the road and costs of the dismantle expenditure, the Gram Panchayat is ready to remove the said road.

6. The Gram Panchayat has no objection if the petitioner removes the said road to use the same as per his wish.

Accordingly, the Writ Petition is disposed of, by placing on record the above written instructions, permitting the petitioner to act in accordance with the above instructions. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions in this Writ Petition, if any, shall stand closed. __________________ A.V.SESHA SAI,J 16th April, 2018 Tsy
