THE HON'BLE SRI JUSTI CE ABHI NAND KUMAR SHAVI LI WRI T PETI TI ON NO.5743 OF 2004 ORDER:

The petitioners have challenged the orders of discharge dated 26.10.1995 by filing this Writ Petition in the year 2004 i.e., nearly after nine years after the orders of discharge. No interim orders were granted and admittedly, the petitioners were appointed as Home Guards way back in 1990-1991. It is almost more than two decades back the services of the petitioners were disengaged. At this point of time, the question of considering the cases of the petitioners as Home Guards may not be feasible.

In view of the above, this Court is of the considered view that the relief sought for by the petitioners to re-engage them as Home Guards is not feasible as their services were discharged more than two decades back.

There are no merits in the Writ Petition and the same is dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
