THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.9571 OF 2018 ORDER:
Heard learned counsel for the petitioners and learned Government Pleader for Revenue appearing for respondents 1 and 2.
2.
Petitioners claim to be the owners of lands admeasuring Acs.1.36 guntas in Survey No.456, Ac.1.01 guntas in Survey No.457 and Acs.4.06 guntas in Survey No.496 of Chattanpally Village, Farooqnagar Mandal, Mahaboobnagar District, having succeeded to the said property from their grandfather. Petitioners now allege that as a consequence to the Revenue Land Updation Programme conducted by the Government, the respondent authorities are making attempt to delete the names of the petitioners from the revenue records.
3.
From a reading of the prayer in the Writ Petition, it is clear that so far no action is taken against the petitioners. In other words, petitioners are seeking a preemptive direction not to take any action against them. However, no such direction can be given to the respondent authorities. The writ Court can go into the decision made by the competent authority within the parameters of the judicial review only when a decision is made by the authorities concerned. In the instant case, so far no decision is made. Hence, the Court is not inclined to entertain the Writ Petition. 4.
The Writ Petition is accordingly dismissed leaving it open to the petitioners to work out their remedies as and when an adverse
decision is taken against them. There shall be no order as to costs.
Miscellaneous Petitions, if any, filed in this Writ Petition shall stand closed.
