ORDER

This writ petition is filed seeking the following relief: "...to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus to declare the action of the respondent authorities in not increasing the basic pay during the period from 5.5.1995 to 6.4.2006 i.e., till the date of sanctioning of annual increments dt 6.4.2006 in Case No.E1/255(3)/2006 in spite of the written representation dt 25-12-2017 followed by personal visits as being illegal, arbitrary and unjust and consequently direct the respondent authorities to m increase the basic pay of the petitioner from 5.5.1995 to 6.4.2006 and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case and in the interest of justice."

Heard learned counsel appearing for the petitioner and learned Standing Counsel appearing for the respondent-Corporation.

It is the case of the petitioner that he was appointed as Cleaner in the respondent-Corporation in the year 1979. Thereafter, he was promoted as Mechanic. His grievance is that his basic pay was not increased for the period from

5.5.1995 to 6.4.2006 and annual grade increments were also not granted; that the respondent-Corporation imposed the punishment of reduction of minimum time scale from Rs.2,145/- to Rs.1,705/- with effect from 5.5.1995. After reduction of his pay scale, the respondents have not granted any increments and in spite of the same, the petitioner had served the respondents upto April, 2006. Therefore, the petitioner has submitted a representation to the respondents on 25.12.2017 requesting the respondents to increase his basic pay from 5.5.1995 to 6.4.2006. But, so far, the respondents have not passed any orders on the said representation.

Learned counsel appearing for the petitioner submits that appropriate orders be passed directing the respondents to consider and dispose of the representation dated 25.12.2017 submitted by the petitioner. Learned Standing Counsel appearing for the respondent-Corporation submits that the representation dated 25.12.2017 submitted by the petitioner would be considered and appropriate orders would be passed.

Having considered the rival submissions made by the learned counsel on either side, this Writ Petition is disposed of directing the respondents to consider the representation dated 25.12.2017 and pass appropriate orders thereon within a period of eight weeks from the date of receipt of a copy of this order. No costs. Miscellaneous petitions pending, if any, shall stand closed.
