Suresh Prasad v. The Commissioner Of Employment And Training
HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WP No.9572 OF 2018 ORDER:
The case of the petitioner is that the he filed OA No.4101 of 2013 on the file of AP Administrative Tribunal, Hyderabad, and the same was disposed of by order dated 08-09-2016. The operative of the order reads thus:- "6. In view of the above submissions, the respondents are directed to consider the case of the applicant for promotion to the post of Office Superintendent/Junior Employment Officer, with effect from 28-06-2002 and pass appropriate orders within a period of three months from the date of receipt of a copy of this order, by issuing notices to the affected parties. The OA is disposed of accordingly."
The petitioner is stated to have made representation to the respondents to implement the above order passed by the Tribunal, but it is stated that in view of the mistake crept in the order passed by the Tribunal, as regards the date i.e. "with effect from 28-06-2002" instead of "with effect from 28-062007," the respondents are not implementing the order and now there is no possibility of approaching the Tribunal seeking correction of the date which is wrongly typed in the order, as the Tribunal stood abolished, in so far as the State of Telangana is concerned. Hence, this writ petition.
The submission of the learned counsel for the petitioner that the effective date is wrongly typed in the order of the Tribunal as 28-06-2002 instead of 28-06-2007 is not disputed by the learned Asst. Government Pleader for Services. In the circumstances, the respondents are directed to implement the order passed by the Tribunal in OA No.4101 of 2013, dated 08-09-2016, treating the effective date as 28-062007 instead of 28-06-2002 and pass appropriate orders thereon in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. The writ petition is disposed of accordingly. Miscellaneous petitions, if any pending in this case shall also stand disposed of. There shall be no order as to costs.
