THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.2841 of 2016 ORDER:
The petitioner, who is an accused in Crime No.4 of 2016 of Yetapaka Police Station, East Godavari District, registered for an offence punishable under Section 8(c) read with Section 20 (b)(ii)(c) NDPS Act, filed the present application under Sections 437 and 439 of the Code of the Criminal Procedure (Cr.P.C.), seeking enlargement on bail in the above said crime.
At the time of arguments, learned counsel for the petitioner stated across the Bar that the petitioner who is suffering with Hepatitis-B has been taking periodical treatment and hence his request may be considered.
Learned public prosecutor placed before the Court a letter dated 09.03.2016, issued by Superintendent of Jails, Central Prison, Rajamahendravaram, wherein it is stated that the petitioner was never referred to any hospital from the date of his admission in the said prison. It is further said that the institution referred the petitioner to the Government District Hospital, Rajamahendravaram on 10.03.2016 for general check up by a specialist.
Having regard to the circumstances stated above, learned counsel for the petitioner seeks permission to move the trial Court with all necessary documents for grant of regular bail. Permission as sought for is granted and the Criminal Petition is disposed of by giving liberty to the petitioner to move the trial Court, in which event the same shall be dealt with, in accordance with law. As a sequel thereto, Miscellaneous Petitions, if any, pending shall stand closed.
