THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.10146 OF 2018 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking verbatim the following relief: "to issue Writ, order or direction preferably Writ of Mandamus declaring the seizure of the premises bearing H.No.5-14-2, M.G. Road, Kothagudem, by the 4th Respondent vide Seizure Panchanama dated 07/02/2018 as illegal, arbitrary, without jurisdiction and violative of principles of natural justice and violative of Articles 14 & 19 (1)(g) of the Constitution of India and consequently, set-aside the said Seizure Panchanama dated 07/02/2018 and further direct the Respondents not to interfere with the Clinic being run by the Petitioner in the said premises."

I have heard the submissions of Sri M.M.M.Srinivasa Rao, learned counsel for the petitioner, of the learned Government Pleader for Medical and Health (TG), appearing for the respondents 1 and 3, and of the learned Government Pleader for Revenue (TG), appearing for the respondents 2 and 4. I have perused the material record.

At the hearing, learned counsel for the petitioner submits that though several averments are made and the above relief is claimed in the writ petition, the grievance of the petitioner stands redressed if a direction is given to the respondents 2 and 3 to consider and dispose of the representation, dated 12.02.2018, of the petitioner in accordance with law.

Learned Government Pleaders appearing for the respondents 1 to 4 endorses the said submission.

Recording the submissions, the Writ Petition is disposed of directing the respondents 2 and 3 to consider and dispose of the representation, dated 12.02.2018, of the petitioner in strict accordance with the procedure established by law, however, within a period of four (4) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
