ORDER

This criminal petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings in C.C.No.592 of 2017 on the file of the II Additional Chief Metropolitan Magistrate, Hyderabad. Heard learned counsel for the petitioner.

Learned Public Prosecutor opposed the petition on the ground that the petitioner can file a discharge petition before the Court below as charges are not yet framed.

This Court also agrees with the said opinion expressed by the learned Public Prosecutor. As the petitioner has an alternative remedy, he can as well exhaust the said remedy and there is no necessity for this Court to exercise powers under Section 482 Cr.P.C at this stage.

Hence, the Criminal Petition is dismissed. However, the petitioner is at liberty to approach the Court concerned and file a discharge petition.
