THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.8296 OF 2016 O R D E R :

Heard counsel for the petitioners and the Government Pleader for Revenue appearing for the respondents.

Petitioners contend that they have purchased small plots of land under various sale deeds and that the respondents are trying to dispossess them without waiting for the 4th respondent to pass orders on the proceedings initiated against the petitioners under the provisions of the A.P. Land Encroachment Act, 1905 (for short 'the Act'). 3.

Reference is made by the counsel for petitioners to notices issued under Section 7 of the Act to the petitioners in respect of the plots in their occupation. He also stated that the petitioners have submitted explanation to the said notices and without passing any orders thereon, the 4th respondent is trying to dispossess the petitioners from the plots in their occupation. 4.

The Government Pleader for Revenue appearing for the respondents states that the 4th respondent will pass orders after considering the petitioners' explanation to the notices issued under Section 7 of the Act and he will then take further action against the petitioners, in accordance with law.

5. In view of the said submissions, the Writ Petition is disposed of directing the respondents not to evict the petitioners from the plots in their occupation till the final orders are passed by the 4th respondent in the proceedings initiated against the petitioners under the provisions of the Act. There shall be no order as to costs.

6. Consequently, Miscellaneous Petitions pending if any, shall stand closed.
