HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 29421 OF 2017 ORDER :

It is the case of petitioner that she retired from service on attaining the age of superannuation on completion of 58 years age and the Government has issued G.O.Ms.No.138, dated 08.08.2017 enhancing the age of superannuation from 58 years to 60 years making it applicable to employees who already retired also and that the petitioner is entitled for the same benefit in terms of G.O.Ms.No.138, dated 08.08.2017. As the petitioner is not reinducted by the respondents in terms of aforesaid G.O., present writ petition is filed. Heard learned counsel for the petitioner and Sri P.Subhash, learned Standing Counsel for the respondents 3 to 5.

Sri P.Subhash, learned Standing Counsel for the respondents 3 to 5, on instructions submits that in terms G.O.Ms.No.138, dated 08.08.2017, the Board of Directors have taken a decision to enhance the age of employees from 58 to 60 years and sent the same to the Government on 08.09.2017 for amending the Byelaw No.23 (i) of Common Service Byelaws of A.P B.C Cooperative Finance Corporation Ltd., and that the same requires approval from the Government in terms of G.O.Ms.No.138, dated 08.08.2017.

Both the learned counsel submits that the writ petition can be disposed of recording the aforesaid submissions. In view of the same, this writ petition is disposed of directing the respondents to consider the case of the petitioner for his re-induction immediately after Government takes a decision and grants approval. The said exercise shall be completed within a period of four weeks from the date of receipt of a copy of this order.

There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of.
